This document sets out the Terms of Use and Privacy Policy of ClearMD ("we", "us", or "ClearMD") and governs your use of the platform (the website and any related applications, the "Service"). Please read it carefully — using the Site constitutes acceptance of these terms.

1. About the Service

ClearMD (the "Site" or "Service") is a digital platform for finding doctors and reading patient reviews in Israel. Browsing and/or using the Site constitutes full acceptance of these terms. If you do not agree to these terms, please refrain from using the Site.

2. Not Medical Advice

The information presented on the Site, including doctor profiles, specialties, biographies, and reviews, is provided for general informational purposes only and does not constitute medical advice, diagnosis, or a treatment recommendation of any kind. ClearMD is not a medical provider, does not deliver healthcare services, and is not a party to any engagement between a patient and a doctor. Any decision regarding choice of doctor, treatment, or medical consultation is the sole responsibility of the user, who is advised to consult a qualified professional before making any medical decision.

3. User Content and Reviews

Reviews published on the Site reflect the personal, subjective experience of the patient who wrote them, and do not constitute fact, professional determination, or the position of ClearMD. ClearMD does not edit, verify, or guarantee the accuracy, truthfulness, or completeness of any review, and assumes no responsibility for content published by users. Every review undergoes administrative moderation prior to publication; however, this moderation does not constitute factual verification of the review's content and is not a guarantee of its correctness. ClearMD reserves the right, at its sole discretion, to refuse to publish, remove, or edit any content that violates these terms, including content that is defamatory, abusive, false, misleading, or unlawful.

4. Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied. ClearMD does not warrant that the Service will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, ClearMD, its officers, employees, and agents shall not be liable, directly or indirectly, for any damage — direct, indirect, consequential, special, or punitive — suffered by a user, doctor, business competitor, or any third party as a result of using the Site, relying on content published on it (including reviews, ratings, and information about doctors), or being unable to use the Service. Should any liability nonetheless be found to apply to ClearMD notwithstanding the foregoing, ClearMD's total liability to any user for any claim shall not exceed the amount, if any, paid by that user to ClearMD in the twelve months preceding the event giving rise to the claim.

5. Indemnification

You agree to indemnify and hold harmless ClearMD, its officers, and employees against any damage, loss, liability, claim, or expense (including reasonable attorneys' fees) arising from your breach of these terms, from content you publish on the Site (including reviews), or from unlawful or unauthorized use of the Service.

6. Notice and Takedown Procedure

ClearMD operates in accordance with the "Notice and Takedown" principle, as shaped by Israeli case law concerning the liability of operators of user-generated-content platforms. Under this principle, ClearMD is not automatically liable for content published by users, provided it maintains a clear process for evaluating complaints about harmful content. A doctor who believes that a review published on their profile is defamatory, false, violates privacy, or does not reflect an actual visit may file a notice ("report") using the "Report this review" button available in their personal dashboard after signing in — so that every report is identified and tied to the doctor whose profile the review was published on. A patient or any other third party who believes a particular review violates these terms is welcome to contact us directly at clearmd1@gmail.com, and their complaint will be evaluated through the same process. The notice should include the complainant's identification, identification of the review in question, and the reason for the complaint. Upon receiving a substantiated notice, the review is temporarily removed from public view pending review. The ClearMD team will examine the complaint and may contact the author of the review (where contact is possible) to request basic proof of the visit (such as the visit date or other identifying details). A review whose authenticity cannot be verified, or that is found to violate these terms, will be permanently removed. A review found to be legitimate will be restored to public view. This procedure does not constitute a legal determination as to the truth of the content and does not derogate from any party's right to pursue direct legal action against the author of the content. ClearMD retains sole discretion regarding whether to remove content temporarily or permanently, including the right to reject complaints that are insufficiently substantiated or filed in bad faith.

7. Information We Collect

We collect the following categories of information: (a) account details of doctors and administrators who register for the Service (name, email, photo, and professional profile details) via Supabase Auth; (b) review content submitted by patients — reviews are submitted without identification and without requiring registration, and we do not collect the identity of the patient who wrote the review; (c) submissions made through the contact form, the "Join as a Doctor" form, and the review-report form (name, email, and the content of the message); (d) basic usage data required to operate the Site, including a preferred display-language setting stored in a cookie.

8. How We Use Information and Share It with Third Parties

Information is used solely to operate the Service: displaying doctor profiles and reviews, enabling contact between patients and doctors, responding to inquiries, and improving the Site. We do not sell personal information to third parties. To operate the Service, we rely on sub-processors acting on our behalf and bound by confidentiality obligations, including: Supabase (data storage, user authentication, and file storage) and Resend (sending email notifications). These providers' servers may be located outside Israel; by using the Site, you consent to such transfer of information.

9. Your Privacy Rights

In accordance with the Israeli Privacy Protection Law, 5741-1981 (including Amendment 13), every user may contact us to request access to, correction of, or deletion of information held about them, subject to applicable law. Such requests may be submitted by email to clearmd1@gmail.com. We will endeavor to respond within a reasonable time. Note that deleting a doctor's account may require additional coordination due to reviews and public information linked to the profile.

10. Cookies

The Site uses only two types of cookies, both strictly necessary for it to function: 1. Session (authentication) cookie — an HTTP-only cookie used to manage a secure session for logged-in doctors and administrators. This cookie is not used for tracking or advertising. 2. Language-preference cookie (clearmd-language) — remembers your chosen display language (Hebrew/English/Arabic/Russian) for future visits. The Site does not use advertising, tracking, or third-party analytics cookies (such as Google Analytics or Facebook Pixel). As these are strictly necessary and functional cookies only, no prior consent (cookie banner) is required for their use. You can block or delete cookies via your browser settings, but doing so may prevent you from staying signed in to the Site.

11. Intellectual Property

All rights in the Site's design, code, logo, and content developed by ClearMD (including blog articles) are reserved exclusively to ClearMD. A doctor uploading a photo or content to their profile represents that they own the rights to that content and grants ClearMD a license to display it as part of the Service. The author of a review retains rights in the content they wrote and grants ClearMD an irrevocable license to display, reproduce, and distribute that content as part of the Service.

12. Minors

The Service is not intended for use by minors under the age of 18 without the supervision and consent of a parent or guardian. ClearMD does not knowingly collect information from minors.

13. Changes to This Policy

ClearMD may update this policy from time to time. The date of the most recent update will appear at the top of this document. Continued use of the Site after changes are published constitutes acceptance of the updated policy.

14. Governing Law and Jurisdiction

These terms are governed exclusively by the laws of the State of Israel, without regard to conflict-of-laws principles. Exclusive jurisdiction over any dispute arising from use of the Site is vested in the competent courts of the Tel Aviv-Jaffa district.

16. Declaration of Compliance with Medical Advertising Regulations (Doctors)

A doctor registering for any ClearMD plan (including basic and premium tiers) hereby declares and undertakes that all material, images, text, or information uploaded to their profile on the Site comply with the advertising guidelines of the Israeli Ministry of Health, including the Physicians Regulations (Prohibited Advertising), 5746-1986, and any subsequent amendments, updates, or administrative directives issued by the Ministry of Health. The exclusive responsibility for compliance with these regulations rests solely with the doctor. ClearMD is not a supervisory body over medical content and does not review profile materials for compliance with medical advertising law. Each doctor must independently ensure that their profile does not include: promises of therapeutic success; academic or professional titles not approved by a competent authority; improper comparative claims; misleading information; or any other content prohibited in medical advertising under applicable law. Breach of this declaration may result in, among other things, suspension of the profile until the offending content is removed, without derogating from any other remedy available to ClearMD under this agreement or applicable law.

17. Remote Transaction, Subscription Cancellation & Payment Policy (Doctors)

The paid subscription plans offered to doctors through ClearMD constitute a remote transaction as defined under the Israeli Consumer Protection Law, 5741-1981, and the Consumer Protection Regulations (Transaction Cancellation), 5771-2010. Prices & VAT: All prices displayed on the Site are exclusive of Value Added Tax (VAT), unless explicitly stated otherwise. The total amount charged will include VAT at the applicable statutory rate (currently 17%). Recurring billing: Subscriptions are billed on a monthly recurring basis and renew automatically at the start of each billing period until cancelled. A reminder notification will be sent before each automatic renewal. Cancellation: A doctor may cancel their subscription at any time by clicking the 'Cancel Subscription' button in their personal dashboard, or by sending a written request to clearmd1@gmail.com. Cancellation takes effect at the end of the current billing period; access to Pro features is retained until then. No pro-rated refund will be issued for unused days in a period already paid, except where otherwise required by law. 14-day cancellation right: Under the Consumer Protection Regulations (Transaction Cancellation) 5771-2010, a doctor is entitled to cancel the initial subscription transaction without charge within 14 days of placing the order, provided the service has not yet been activated (i.e. no paid features have been used). Once the service has been activated, the right of cancellation may be limited in accordance with the Regulations. Price changes: ClearMD reserves the right to change subscription rates with at least 30 days' advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new rate.
